1. Definitions

1.1 "Products" means any products sold by Divine Jewellery on this site and are the subject matter of this contract.

1.2 "G.S.T" means New Zealand Goods and Services Tax at 12.5% of the purchase price.

1.3 "Nominated Payment Authority" means Visa, Mastercard, American Express.

1.4 "Site" means the Divine Jewellery website and affiliated Internet websites.

1.5 "Cheque" refers to cheques from New Zealand only.

2. Introduction

2.1 This site is owned and operated by Divine Jewellery. By using this site, you agree to these terms and conditions. If you disagree with any of these terms and conditions, you should not access or use this site.

2.3 All prices referred to in these terms and conditions on this site are in New Zealand dollars and U.S Dollars for the Paypal payment server.

3. Orders, Price and Payment

3.1 The customer must order the products in accordance with the instructions of this site.

3.2 Products will be paid for by authorising our payment sever PayPal to charge any one of your nominated payment authorities. Mail order options require payment via New Zealand Cheque.

3.3 The price for products shall be the price quoted on the site at the time of making an order. All prices are inclusive of G.S.T.

3.4 The purchase price does not include the cost of freight.

3.6 Payment in full for the products ordered will be made on the date of despatch of the products from the nominated payment authority. Divine Jewellery is not responsible for any variation in price caused by currency fluctuation from the time of order to the time of despatch of products.

3.7 All payments will be collected in New Zealand or United States Dollars for our Paypal payment server. We do have an currency converter facility for your information so you can view approximate costs in your currency.

3.8 Payment using Paypal will require you set up an account with Paypal using advanced security processes. You may use this account to shop with thousands of shops using the Paypal system. This will also make it easier for future purchases from Divine Jewellery. When joining and paying with Paypal you need to accept the terms and conditions of the payment server.

4. Products

4.1 Divine Jewellery may revise and/or discontinue or vary products from time to time without notice. Divine Jewellery shall not be liable to any person if Divine Jewellery is unable to or elects not to supply the products ordered because of an unforeseen change to the goods or for any other reason.

4.2 Because the products supplied by Divine Jewellery are produced from natural materials there may be some significant variation in colour, texture, grain and pattern from the products depicted in images on this site.

5. Delivery and Freight

5.1 Divine Jewellery will endeavor to despatch the products on the day the order is received or if not on the next business day after the day the order is received.

5.2 Divine Jewellery will use all reasonable effort to deliver the product in an acceptable condition to the delivery address specified by the customer.

5.3 Unless otherwise stated, the cost of freight and delivery will be payable by the customer and will be listed separately on the payment invoice forwarded with the product or advised to the customer by Divine Jewellery at the time or soon after the customer placing the order.

5.4 The price of frieght may change at the discretion of Divine Jewellery and frieght cost will be published on our website. The nominated carrier of our freight may change without notice.

5.5 Freight times are two days in New Zealand and one week for international. This may vary from time to time. All communication channels will remain open at all times for customer questions and feed back.

5.4 Notwithstanding clause

5.1 and 5.2 Divine Jewellery shall not be liable for failure to deliver on a timely basis whether the failure to deliver on a timely basis has been due to causes beyond the control of Divine Jewellery or otherwise.

5.5 Divine Jewellery is not liable for any import duties or taxes levied on the products imposed by authorities in any country outside New Zealand. Such charges are the liability of the customer resident in that country or who ordered the items delivered to that country outside New Zealand.

5.6 Divine Jewellery will not deliver to Post Office boxes

5.8 Divine Jewellery is not liable for cheques lost in the mail or during transit from the customer, to us, Divine Jewellery the supplier.

5.9 Goods paid for by cheque will have 5 days added to the delivery time, for cheque clearance.

6. Cancellation

6.1 The customer may vary, amend of cancel the order up to the time of despatch by Divine Jewellery and will not incur any cost for doing so.

7. Warranties and Guarantees

7.1 Divine Jewellery will use all reasonable endeavours to supply top quality products and if in any case the product is damaged due to our negligence Divine Jewellery will replace or refund as required by the New Zealand Consumer Guarantees Act.

7.2 Except as provided by law, no warranty or guarantee, is given or liability accepted for any damage to the products due to external causes, including accident or misuse or use of the product other than for the manner intended for the product.

8. Return of Products / Refunds

8.1 Subject to the rights and powers contained in the Laws of New Zealand after the date of despatch the customer may not return the product if for example they no longer wish to purchase the product or for any other reason decide not to purchase the product.

9. Property / Risk

9.1 The property and risk in the product shall pass to the customer upon despatch by Divine Jewellery customers delivery address.

10. Applicable Laws

10.1 This site is operated from New Zealand and its operation and the supply of goods from this site are governed by New Zealand Law.

11. Disclaimer

11.1 Every effort is made to ensure the information provided on this site is correct and accurate, but Divine Jewellery does not warrant its accuracy or completeness and reserves the right, but makes no commitment, to update or correct the terms and conditions and information and images contained in this site at any time without notice
